Here in Tennessee (United States) we do not have to tell them what they are being arrested for. Its just a good rule of thumb to so they understand whats going on. Now if its an arrest where safety is an issue then screw telling them what they are being arrested for. After they are restrained and searched then I will explain things to them.

we dont read them there rights until we get back to the station, keep in mind im not saying your wrong…maybe your country, state, or what ever does things a little bit diff….also MARCACOW….i dont know if your state does things diff….i would assume most states do the same thing……it is not illegal to refuse to sign a citation…all you have to do is put in where they were supposed to sign is “refused to sign”…..and they get the ticket anyway….

well classic thrash…first off congrats on going through the academy…im a military cop, in texas. ummm first though….he was no victim…he was the subject…second, i dont, and most of the other officers i know dont tell subjects why there getting apprehended before we place them in hand irons…for the simple reason that there more then likely going to resist if they dont understand why, or dont believe they committed that offence…on the military instalation that im on…

Thanks a lot, Im very excited about it as well. Im Canadian, and I would assume that law would apply in all developed countries. One of the first things I learned was that if you don’t tell the individual what theyre being arrested for, and you arest them, you will get nailed in court, no matter what the crime is. And believe it or not, it is extremely difficult to get fired as an officer. Police unions have so much power, its rare that an officer will loose his job. Hope that helped!

Just a couple of questions: In your state, does the law specifically require the police to tell an offender what he’s being arrested for, regardless of how hectic or dangerous a situation is? Also, with respect to your belief that the officer will be punished when this case goes to court, are you aware that the officer is still employed by the Utah Highway Patrol? Actually im in a police Academy, the police officer broke the law first by not telling the victim what he was being arrested for. The man will not be arrested, the police officer will be punished so hard when this comes to court. The lawyers are going to nail him.
