actually, the officer already cited the man before asking for consent to search. Had the man politely declined, he would have been free to go. The Supreme Court has stated that once an officer cites an individual, that individual is free to go. If the individual sticks around, it is of his own free will. After citing an individual, an officer needs additional probable cause to detain further without consent.

He had no strong reasoning or evidence that the man had drugs. Dogs wouldn’t have been called, man would have gone on his way. They’d need a helluva lot more dogs if they were gonna sniff out every person who got a speeding ticket & refused a search! Just like if they want to search your home but need a warrant they will stay at your house or with you until they get one to make sure that you dont remove anything that could be evidence. A car doesnt normally require a warrant since its mobile and the process would take too long so instead they go with plain view, smell, and K9’s all these things give them probable cause

They are legally detaining you by pulling you over in the first place So yes they can make you wait they just detain you longer I am telling you I know for a fact this happens its just whether or not the cop thinks it would be worth bringing the dog out If his gut is telling him to then he might but if he isnt feeling it strong enough or just doesnt want to then he lets you go.
