he was NOT out of the road. he was clearly over the white line. Sure, the truck wasn’t exactly in his lane, but the car was still in the road.

Not really, trucks also have 8 brakes. While they can’t stop on a dime, they can slow down faster than you might think. There is NO excuse for the trucker to be going that fast, as he had long since seen the lights of the trooper and should have been slowing down and preparing to move to the left lane as soon as it was safe.
That will be one vehicular manslaughter charge for the trucker.
